The courts of some contracting States party to the CMR, including the German courts, interpret the phrase ‘the same grounds’ restrictively. They take the view that the aforementioned reciprocal actions do not relate to ‘the same grounds’ since one action seeks only a (negative) declaration while the other action seeks performance. In their view, the legal protection sought in an action for performance goes beyond the subject-matter of an action for a declaration, which means that the two do not share the same subject-matter.

Os tribunais de alguns Estados contratantes da Convenção CMR, como os tribunais alemães, interpretam restritivamente o conceito de «mesma causa». São de opinião de que as acções acima mencionadas não dizem respeito à «mesma causa», pois uma acção é de simples apreciação (negativa) e a outra de condenação. O objectivo da acção de condenação vai para além do pedido de declaração, pelo que não existe identidade do pedido nos dois litígios.
