I think that is right. The sentence essentially asks the court to dismiss the case in so far that it may be valid in the eyes of the same court. If they are later still going to argue that some of those facts related to the case are not valid to the court, or they have already argued that, then it is, in legal terms, logical that they would say this. If the case, or complaint as they call it, is not valid it cannot be dismissed. Hence, they explicitly state that it may not be valid, otherwise they would be contradicting themselves.

Non-legally speaking, I would think, if it can be entertained by the court. I don't know if this is a matter of standing or of the validity of the complaint.

It seems to me that the author meant "soweit darauf einzugehen ist," i.e., something like "inasmuch as the complaint necessitates a response" or "inasmuch as needs going into."
