"u izviđajnom i u istražnom postupku može preduzimati radnje..."

Istražni postupak znam da je investigation/investigative proceedings, ali ne mogu da nađem "izviđajni" a da nije takođe prevedeno kao "investigative"...

možda je izviđaj utvrđivanje činjeničnog stanja?

Uh... "...Reforma u oblasti krivičnoprocesnog zakonodavstva u Crnoj Gori ...Iz pravnotehničkih razloga napravljene su neke terminološke izmjene kao što je izviđaj umjesto pretkrivičnog postupka i slično.
...Promjena koncepcije istrage odrazila se i na strukturu krivičnog postupka.
Naime, sada imamo sudski krivični postupak (ili postupak u užem smislu), koji započinje dostavljanjem optužbe sudu (potvrđivanjem optužbe) i završava se donošenjem pravosnažne presude i krivični postupak u širem smislu koji uključuje istragu i izviđaj."

"prethodni krivični postupak" Interesantno - već sam imao izraz "prethodni krivični postupak" koji sam bio preveo kao "preliminary criminal proceedings" ali sudeći po vašim odgovorima, izgleda da tu postoje neke finese pa ću morati da saznam na šta se ustvari misli. Nešto mi se čini da se ne radi o "inquest" (jer je kontekst nadležnost organa unutrašnjih poslova) ali onda je pitanje šta je "prethodni krivični postupak"...

Understanding inquest proceeding and how it differs with preliminary investigation may spell the difference between liberty and a night or two behind bars.

The Supreme Court in a 2006 administrative case clarifies that preliminary investigation is a proceeding distinct from an inquest. A preliminary investigation is "an inquiry or proceeding to determine whether there is sufficient ground to engender a well-founded belief that a crime has been committed and the respondent is probably guilty thereof, and should be held for trial."

An inquest is "a summary inquiry conducted by a prosecutor for the purpose of determining whether the warrantless arrest of a person was based on probable cause."
