Found some google references in EUR-LEX, which I can't access with a license it seems.

Instrutor/instrução A fase de discussão e elucidação dos factos que antecipa a fase de decisão. It is the preliminary phase. So instrutor (adj) is also used sometimes to mean preliminary. Ergo: preliminary internal appeal procedure.

Let's elaborate... Your question was: how should I translate processo instrutor? My answer is, based on a similar text: investigation file...

Okay but can you elaborate? The words investigation or file do not occur in the original Portuguese so how does it come to mean what you suggest. I need this information to make an informed decision and also to grade, as required.

Uma violação do direito de acesso ao processo só pode originar uma anulação total ou parcial da decisão da Comissão se o acesso irregular ao processo instrutor no procedimento administrativo tiver impedido a ou as empresas em causa de tomarem conhecimento de documentos susceptíveis de ser úteis à sua defesa, violando, assim, os seus direitos de defesa. Será esse o caso se, com a divulgação de um documento, pudesse ter existido uma possibilidade, mesmo que reduzida, de o procedimento administrativo ter culminado num resultado diferente se a empresa em causa tivesse podido invocar esse documento no referido procedimento.

A breach of the right of access to a file can entail annulment of a Commission decision in whole or in part only where the lack of proper access to the investigation file during the administrative procedure had prevented the undertaking or undertakings concerned from perusing documents which were likely to be of use in their defence and had thus infringed their rights of defence. That would be the case if disclosure of a document would have had even a slight chance of altering the outcome of the administrative procedure if the undertaking concerned had been able to rely on it during that procedure.
