In our judgment there is no cause to doubt the safety of the convictions and this appeal is dismissed.
Podle našeho názoru není důvod k pochybnostem o správnosti rozsudku a toto odvolání se (proto) zamítá. ???
Unsafe judgment jsem našla jako napadnutelný rozsudek, ale napadnutelnost mi tady úplně nesedí, protože je to v kladném významu.

THE Court of Appeal must allow an appeal against conviction if the judges think it is unsafe. That has the effect of quashing the conviction. But the Criminal Appeal Act, 1968, allows judges to order a retrial on similar charges.
The Act says: "Where the Court of Appeal allow an appeal against conviction and it appears to the court that the interests of justice so require, they may order the appellant to be retried."
In deciding whether to order a retrial, the court will take account of the length of time since the alleged offence and the strength of the evidence. The graver the crime, the more likely it is that a retrial would be in the interests of justice."
rozsudky, které jsou považovány za takové rozsudky, u kterých se nelze (v protikladu k "unsafe") domáhat změny či zrušení z důvodů porušení zásad procesního práva či nepravdivých důkazů či svědecké výpovědi - u "unsafe convictions" k tomu ještě přistupuje zájem justice - české právo podobný pojem nezná, ale blíží se tomu dovolací řízení, kdy jde o rozsudky napadnutelné dovoláním, o kterém rozhoduje NS a důvody stanoví TŘ - nejedná se o posouzení právního názoru nižšího soudu
