Orig
"El plan de pensiones se dará de alta sin designación expresa de beneficiarios, de manera que en caso de fallecimiento del partícipe, los beneficiarios serán por orden preferente y excluyente: el cónyuge no separado legalmente; los hijos a partes iguales; los padres a partes iguales; y los herederos legales."

Rough draft:
The pension plan will be activated without the express appointment of beneficiaries, so that in the event of death of the plan holder, beneficiaries will be ordered preferentially and exclusively, i.e. the spouse, the descendants in equal parts, the ascendants in equal parts, and the legal heirs.

Phil, thanks. Didn't catch that one, it's a rush revision (the best kind).
philgoddard May 17, 2012:
I can see what it means - the beneficiaries are ranked, so that if there's no spouse it goes to the children, and so on - but I can't think of a concise way of saying it.
I don't agree with your translation of "padres" and "hijos" - it's parents and children.

exclusive order of preference

The exclusive order of preference of "beneficiaries" under LSA-C.C. art. 2315 may suggest wrongful death damages are more punitive than actual, since there is no reparation of actual damages of excluded beneficiaries, e. g. parents where the child is married.

There is an exclusive order of preference, a pecking order so to speak, as to who can and who cannot bring the claim.

(h) Registration by a third party. The child does not necessarily have to be registered by the parents and may be registered by other persons, in the following exclusive order of preference: one or both of the parents; siblings who have attained their majority; aunts or uncles; grandfathers or grandmothers; tutors or guardians; persons with legal custody of the child.
