Prior art ΔΕΝ είναι παρελθόν, είναι το παρόν. Σημείο αναφοράς για το prior είναι το μέλλον που αντιπροσωπεύει η ευρεσιτεχνία που υποβάλλεται προς εξέταση.
Στην προς μετάφραση φάση χρησιμοποιείται η ορολογία των ευρεσιτεχνιών κι ας μην είναι κείμενο πατέντας. Σε πιο χαλαρή και μοντέρνα απόδοση η prior art εδώ είναι "υπάρχουσα/τρέχουσα τεχνολογία ~ υπάρχουσα στάθμη της τεχνολογίας"
