The full sentence is: De nalatenschap omvat, naast eventueel eigen vermogen van de erflater, de helft van de door het overlijden ontbonden huwelijksgemeenschap. I am just not sure whether this should be translated as 'own funds', 'capital' etc. Would appreciate your advice/recommendations.

Dit - of eventueel "(the deceased's) own assets" is de vertaling die JurLex geeft waar het gaat om het eigen vermogen van particulieren.

The estate/inheritance includes half of the dissolved matrimonial community of property as well as any of the deceased's personal assets.

personal property/assets

In English you cannot use 'own' the way we do in Dutch. It must have a personal pronoun: my own, his own, etc.

personal estate / personalty

I think in UK inheritance law (is that the region your text is aimed at?) the technical word is personal estate or personalty (rather than assets held in common), referring to everything apart from land or buildings. See if the web reference below is of any help. Personal assets is a term not specific to inheritance law.
