Frank Szmulowicz, Ph. D. Dec 11, 2013:
Please consider my late entry of SOLICITING with a reference source.
Frank Szmulowicz, Ph. D. Dec 10, 2013:
aiding and abetting concerned pomocnictwa i podżegania
Krystian Kop (X) Dec 10, 2013:
"§ 3. Whoever, with an intent that another person should commit a prohibited act, facilitates by his behaviour the commission of the act, particularly by providing the instrument, means of transport, or giving counsel or information, shall be liable for aiding and abetting. Furthermore, whoever, acting against a particular legal duty of preventing the prohibited act, facilitates its commission by another person through his omission, shall also be liable for aiding and abetting."

"§ 2. The person to whom Article 15 § 1 applies shall not be liable to penalty for preparation. Article 18. § 1. Not only the person who has committed a prohibited act himself or together and under arrangement with another person, but also a person who has directed the commission of a prohibited act by another person, or taken advantage of the subordination of another person to him, orders such a person to commit such a prohibited act, shall be liable for perpetration."

perpetration by order

Peer comment(s):

agree Krystian Kop (X) : Zgadzam się. W dyskusji argument za.

(aiding, abetting) and soliciting someone to commit a crime

The technical term is SOLICITING:

A person is guilty of solicitation to commit a crime if, with the purpose of promoting or facilitating its commission, he commands, encourages or requests another person to engage in specific conduct which would constitute such crime or an attempt to commit such crime or which would establish his complicity in its commission or attempted commission. It is immaterial that the actor fails to communicate with the person he solicits to commit a crime if his conduct was designed to effect such a communication.

The crime of criminal solicitation is the actual soliciting, or seeking to engage another to commit a crime, not the subsequent commission of a crime. Therefore, a defendant can be convicted of soliciting, even though the person refuses and the solicited crime is never perpetrated, as long as the intent that that crime be committed is present.

Note from asker:
Soliciting is more like "nakłanianie", while "sprawstwo" involves the actual perpetration of a crime (http://www.prawo24.pl/a/sprawstwo-polecaj%C4%85ce). Thanks for your contribution anyway.
