Hard-pressed by colonists in Georgia, who wanted to expropriate even the Indians' remaining land that was guaranteed by treaty, the Cherokee set up a constitution, following the American example. in which they repeatedly stressed their status as a sovereign nation. They also decided not to sell any more land. The State of Georgia simply ignored this claim to sovereignty, and in a countermove passed a series of laws which declared the constitution of the Cherokee invalid and divided up their territory into separate counties. As a "foreign nation" the Cherokee appealed for help to the U.S. as a protecting power and asked the U.S. Supreme Court to clarify the legal situation. In a verdict that has since become famous the Supreme Court acknowledged that the Cherokee and other similar tribes had all the attributes of a foreign nation, adding, however, that the U.S. could not tolerate any "imperium in imperio". Thus a new legal category was created for tribes as "DOMESTIC DEPENDENT NATIONS" alongside the sovereign federal state and the individual states.
