This is part of a divorce ruling and my problem is whether I should use "in absentia" or default, I can´t seem to get the sentence together, any help would be valuable..... Spanish legalese gives no such ease!

"y de otra y como parte demandada xxxxxxx, mayor de edad y que ostenta xxxxxxxxx y que está en ignorado paradero, incomparecida al proceso en legal forma y declarada en rebeldía, y sobre divorcio con oposición y demás pedimentos conexos y en atención a los siguientes y numerados"

Although in some cases it may be translated as "rebeldía" it does not really means that.<hr> But that is not the contention in this case. I just said that in a divorce case "en rebeldía" should be translated as "by default" or "in absentia". There is no contempt in not showing in a divorce proceding, as I also said it is not a trial in which compearance is mandatory. What happens is that if you do not show then the case is adjudicated to the plantiff, in absentia and by default, and the divorce is declared final, in favor of the plaintiff. So if she was asking for your convertible and the house, she will get them. I know from experience, not as an attorney but as a divorcée ;-)<hr>

In *contempt* in a UK civil action would entail committal to prison for crass rudeness to the judge, hitting a court employee or misbehaviour in court etc. - a disastrous consequence of non-entry of appearance....

Another alternative will be a paraphrase of Tom's answer:

"having failed to show at the proceeding it is adjudicated in absentia.

Or any combination, except the "contempt of court" which is not applicable in a divorce. Or "trial", it is "a divorce proceeding" not "a divorce trial"
