"Art. 401.- Crédito privilegiado.- Lo que se deba por concepto de indemnizaciones según este título se tendrá como crédito privilegiado, con preferencia, aun a los hipotecarios."
Article 401.- Priority payment by law.- Damages owed under this title shall be paid as a legal priority, con preferencia, aun a los hipotecarios.
I'm stumped. TIA.

It means (I think) that the credit referred to in this article shall be treated as a priority claim with preference even over mortgages (mortgage credits): "con preferencia, aun a los [créditos] hipotecarios". That comma after "preferencia" isn't required, and "hipotecarios" means "créditos hipotecarios".
It makes sense, because mortgages are normally preferential claims, with priority over other creditors.

Hi Melissa. It must mean mortgages owed by the employer, who is the person liable to pay the compensation. As you say in the question, this part of the Code is about compensation payable to employees by employers. So it must be talking about priority of debts owed by the employer.
It makes sense, because mortgages are normally preferential claims, with priority over other creditors.
