"Independent de calificarea de către judecătorul sindic a apărărilor formulate de către recurente în sensul respingerii cererii de închidere a procedurii insolvenței, ca fiind inadmisibile, motivat de faptul că nu s-a contestat și raportul final al administratorului judiciar - raport care nu a fost depus în prezenta cauză și care oricum nu trebuie întocmit într-o astfel de procedură cum este cea de reorganizare, apreciază că judecătorul sindic trebuia și din oficiu să se sesizeze cu privire la faptul că pe rolul Curții de Apel se aflau în curs de soluționare contestațiile la tabelul preliminar."
