English term

substitute (verb)

English to German Law/Patents Law (general) Sale of real estate / proxy
Hat das hier schon mal jemand als Verb in einer Bevollmächtigung aus Arizona zum Verkauf einer Immobilie gelesen? "Substitute" als Verb, nur was soll ersetzt werden?

Nach einer vorangehenden Aufzählung:

"To this effect, the attorney may transfer by way of partition, determine the price, fees and conditions, payment dates, receive payment or compensation balance, interest and accessories, to grant surcharge with or without subrogation, determine the date of the beginning of the enjoyment, stipulate all conditions and easements, make all kind of declarations and notifications, accept all guaranties and exempt the mortgage register custodian to record a straight mortgage for whatever reason."

kommt dann das hier, in dem das fragliche Verb steht:

"To the above mentioned effect, pass and sign all deeds, agreements and pieces, file any tax declarations, elect domicile, ***substitute*** or generally do anything that is necessary or useful."

Here are a couple of documents that use slightly different wording for the same concept:

"to this effect,*personally or by means of substitution*, make
all statements, carry out and sign all deeds, minutes, documents and
registers, elect domicile and, in general, do whatever is necessary
or useful with guarantee of approval and ratification by the
undersigned."
www.thrombogenics.com/.../CO-13922900-v2-THR_JAV_2011_-_vol... (sorry, that's a pdf - I realise the link may not work)

"Accordingly, to file all applications, petitions and requests to pay all taxes, to sign all documents and registers, to render all discharges, to file all applications for additions, improvements extensions of term complaints or rectifications, to receive all official certificates or titles, to withdraw all documents and collect all taxes case of rejections or withdrawal, to introduce requests for authorizations, to provide samples, to make declarations, to elect domicile, *to substitute if necessary all or part of the present power*, and, in general to fulfill all that may be necessary for its execution."

It therefore seems to me that the intended meaning is that the attorney can either do the listed things personally or can appoint someone else - a substitute - to carry them out.
Note from asker:
Thank your very much for these references. My feeling is that your conclusion is right. In my proxy, "substitute" is likely to mean that the attorney may charge another person to take charge of her interests.
