"the background to this is that essentially with the bill of quantities the contract was intended to be a measure and value. In other words, the quantities could go up or down depending on the work you do on the job. However, the engineeer assumed that the project was a lone-sum (sic!) contract and the quantities in the bill of quantites were fixed and final"

Jedna sprawa to sprytna nazwa na "measure and value", druga jak mniemam "lone-sum" to "lump-sum", czy też może coś innego? Czy są jakieś sprytne nazwy na te dwa rodzaje kontraktów? Dotyczy budowy drogi.

2. Measurement contract

Measurement contracts (sometimes called “re-measurement” or ‘measure and value’ contracts) contains a Bill of Quantities ( BOQ ) provided by the employer or its consultants, can be used in situations where the design (or type of works) can be described in reasonable detail, but the amount cannot. The contractor will quote against each BOQ item and enter a unit rate or unit price to build up the total contract price on basis of those BOQ quantities. During the construction period, the actual quantity of works executed under each BOQ item will be jointly measured and valued at the quoted rate for interim payment purpose.
A measurement contract might also be appropriate on projects where the design has not been completed in sufficient detail for bills of quantities to be produced.

Lump Sum or Fixed Price Contract

Under a Lump Sum or Fixed Price Contract, the contractor agrees to perform the work specified and described in the contract for a fixed price. The price of a fixed contract can only be changed upon the execution of a change order, under which the owner and the contractor either
(1) Agree for the contractor to perform additional work that falls outside the scope of the original work for an agreed upon extra compensation or
(2) Agree to remove certain work from the original scope of work and reduce the price of the contract in proportion to the work that the contractor no longer has to perform.
These types of contracts are appropriate when a clear scope and a defined schedule have been reviewed and agreed upon.

Lump sum contract

A "lump sum contract" is a contract under which the contractor will receive, on completion of the whole works, a lump sum which is established at the outset of the contract, and which will only be varied under the specific provisions that permit variation in the contract.

Measure and value or remeasurement contracts

"Measure and value", or "remeasurement" contracts, are contracts in which the amount payable to the contractor is determined by measuring the work actually done, and valuing it in accordance with the rates and prices set out in the contract in a bill of quantities, or schedule of rates. This approach allows the contractor to be remunerated fairly in circumstances where the quantity or scope of the work is unknown, whilst holding the contractor to the rates initially tendered.

Ze względu na płatność, wyróżniamy następujące podstawowe formy
Warunków Kontraktowych:
- Ryczałtowy – Cena Kontraktowa jest niezmienna. Nie można żądać
podwyższenia wynagrodzenia, nawet jeśli nie można było w czasie zawarcia
umowy przewidzieć rozmiaru lub kosztu prac. Płatność za całość robót lub za
elementy budowlane (ryczałtowa). Gdy dokumentacja techniczna zawiera błędy
(najczęściej przedmiar robót nie jest spójny z projektem budowlanym) powstaje
wiele roszczeń Wykonawcy.
- Obmiarowy – ustalone są Ceny Jednostkowe za poszczególne roboty oraz
wstępnie ich ilości. Płatność na podstawie Obmiaru Powykonawczego (ilości
pomierzonych po wykonaniu) i ustalonych w Ofercie Cen Jednostkowych. Taka
forma kontraktu to mniejsze ryzyko dla Wykonawcy, ale także zdarzają się
roszczenia Wykonawcy
