3. EXCEPTIONS
3.1 Both parties will not be under any obligation to keep confidential any Confidential Information that it can demonstrate:
3.1.1 Is in the public domain other than as a result of being disclosed in breach of this Agreement;
3.1.2 was received from a source not connected with both parties at a time when that source, so far as the both parties was reasonably aware, was not under any obligation of confidence in respect of the Confidential Information;
3.1.3 was known to both parties before the date of this Agreement and both was not under any obligation of confidence in respect of the Confidential Information at that time.
