Betreuungsbeschluss

Deutsch > Englisch Medizin Recht (allgemein)
Der Patient has zugunsten seiner Ehefrau einen ***Betreuungsbeschluss". Derzeit ist er aber voll orientiert, wach ansprechbar and hat alle bisherigen Entscheidungen mitgetragen.

What is the appropriate English term? Any suggestions?

Discussion

TonyTK Jul 22, 2019:
Just to clarify: it could only be a POA (i.e. LPA) if the German "Betreuungsbeschluss" is being used very loosely. As I understand it, a POA requires capacity on the part of the "attorney giver" and only comes into effect when the person in question no longer has capacity, whereas a "Betreuungsbeschluss" is put in place by a court when the person in question is considered to lack capacity in the first place.
TonyTK Jul 22, 2019:
This does sound ... ... as though it could be a POA. The person in question appears to still possess a significant degree of capacity.

guardianship order

A Guardianship Order authorises a person, or several persons, to act on behalf of and make ongoing decisions for an adult with incapacity, in order to safeguard their wellbeing and promote their interests. This may be where an adult has lost the capacity to make their own decisions, usually as a result of a physical or mental illness. In this context, an adult is someone who is 16 or over but is unable to look after their own affairs. https://www.davidcclapham.co.uk/what-is-a-guardianship-order...

power of attorney

I am pretty sure that this is what it is in the UK, but I am not clear if it is enduring or lasting POA. But that's what it is called when a relative or professional has the authority to act on another person's behalf should the latter no longer have mental capacity.
