Hi Suianne. In fact, he is approving the preliminary plea of nullity, as the text goes on to clarify. However, perhaps as the rapporteur giving his vote, he is only "suggesting" granting the plea to see if the other judges agree with him in their votes. |

I would have thought that the 'de oficio' is the sticking point, namely who is raising the preliminary issue 'ex officio' > of whose - his or her as the Tax Commissioner's (rapporteur's) or the tax tribunal's - own motion.
