Who Are ELL Students?
NCLB uses the term Limited English Proficient (LEP) and defines an ELL student as
an individual who (a) is age 3 to 21 years; (b) is enrolled or preparing to enroll in elementary or secondary school; (c) was not born in the U.S. or whose native language is not English; (d) is a Native American, Alaskan Native, or a resident of outlying areas; (e) comes from an environment in which a language other than English has had a significant impact on an individual’s ELP; (f) is migratory and comes from an environment where English is not the dominant language; and (g) has difficulties in speaking, reading, writing, or understanding the English language that may deny the individual the ability to meet the state’s proficient 3 level of achievement, to successfully achieve in classrooms where English is the language of instruction, or to participate fully in society (NCLB, 2002). Based on the NCLB definition, states typically employ a home language survey, an ELP assessment, and academic achievement assessment(s) in content areas in order to identify ELL students.
