Continued... INTERVENCIÓN MIXTA: cuando tanto las partes como el tercero, en diferente grado y distinta forma, participan y controlan el proceso de búsqueda de soluciones.

En estos mecanismos “las partes enfrentadas someten la solución de sus conflictos a terceros que se encargan de resolverlos independientemente de la autonomía de la voluntad de las partes. En este segundo grupo se ubican tanto los mecanismos de justicia formal como el arbitraje”.

LA INTERVENCIÓN DE UN TERCERO NEUTRAL EN EL PROCESO: Esta intervención puede variar según el grado de su intervención y control del proceso y toma de decisiones. Las siguientes son las clases de intervención:

INTERVENCIÓN INQUISITIVA es aquella en la que el tercero maneja completamente el proceso con muy poca intervención de las partes en conflicto. Esta forma de intervención es típica de los sistemas de heterocomposición, es decir de la justicia formal, en donde es un juez quien toma la decisión, o en el arbitraje, en donde un árbitro decide por las partes.

INTERVENCIÓN DISPOSITIVA: Son las partes en controversia las que manejan el proceso, como ocurre en la mediación o la conciliación.

No existe una correspondencia exacta entre la "heterocomposición" y el litigio, las decisiones judiciales o los procedimientos judiciales, porque la "heterocomposición" también incluye el arbitraje.

Heterocomposición = tribunales y arbitraje; autocomposición = negociación, mediación y conciliación

The arbitration award can still be litigated in narrowly defined circumstances. So a bit of a grey area.

'Arbitration is a procedure in which a dispute is submitted (referred), by agreement of the parties, to one or more arbitrators who make a binding decision on the dispute.'

The formal reference is, literally, defined by the parties' - claimant's / applicant's vs. defendant's or respondent's - 'terms of reference', so is not an informal free-for-all, as some Prozzers have suggested.
Example sentence:

Some complaints are just unamenable to mediation.

International adjudication takes the form of either arbitration by an ad hoc tribunal, or judicial settlement by an international court.

neutral Myriam Seers : "litigation" would usually be understood not to include arbitration though, and arbitration + litigation together = "heterocomposición". We don't have a term in English that combines the two elegantly, hency my awkward descriptive phrase

Judicial settlement

Simple as that. In-court resolution is another option.

Court-mediated dispute resolution

It seems necessary to also provide translations for autotutela and autocomposición as a means of distinguishing the concepts from heterocomposición which requires the intervention of a court of law. I suggest translating the three terms as private settlement; mediation; and court-mediated dispute resolution.

Hi! My understanding is that autotutela is when the parties to a dispute resolve the matter privately without intervention of a court or mediator. Autocomposición is also an out-of-court settlement using the intermediary of a mediator or arbitrator.
