Deputyship and LPA Deputyship enables a carer to make decisions on behalf of the person they care for when the cared-for person lacks capacity to do so themselves. A deputy must act in the best interests of the person they care for and not take advantage of them. LPA is created while the cared-for person still has capacity to make decisions for themselves.

What is a Guardian?

What is a Conservator?

A conservator is a person appointed by the court to manage a minor or incapacitated adult’s estate and finances. This can be a relative, friend, or professional conservator depending on the needs of the specific situation. A conservatorship is established when the ward has assets that must be managed. The conservator has duties including investing funds, collecting on debts in favor of ward, paying for the support, maintenance, and education of the ward and to institute suit on behalf of the ward when necessary.

Deputyship in UK The UK equivalent of a conservatorship is a deputyship. This is applied for at the Court of Protection on behalf of somebody who ‘lacks mental capacity’ meaning they are unable to make decisions for themselves, for example managing their property and finances or have a brain injury, illness or disability. It can be temporary or permanent and the extent and effects will vary from person to person.

There can be two types of deputy in the UK, this can be for personal welfare (making decisions about an individual’s medical treatment and care) and property and financial affairs. Comparing a deputyship with the US counterpart, the Court of Protection would more than likely grant the powers to a suitable professional with experience to handle the individual’s affairs. In Britney’s case this power was given willingly to her father.

Most people have no idea what conservatorship or guardianship is, let alone the difference between the two. And for good reason! These two words can mean completely different things depending on which state you live in. For example, California and Texas have totally separate interpretations of guardianships.
