الدفع بوجود شرط التحكيم
عندما يخل أحد الطرفين بإلتزامه بالتحكيم ويرفع دعواه إلى القضاء بشأن النزاع المتفق عليه يحق للطرف الأخر أن يدفع هذه الدعوى بسبق الإتفاق على التحكيم وأن يطلب من المحكمة رد الدعوى أو بعدم القبول لوجود إتفاق على التحكيم.
