Dutch term

heeft plaats naar de toestand

Dutch to English Law/Patents Law: Contract(s) Prenup
"De verrekening heeft plaats naar de toestand ten tijde van de ontbinding van het huwelijk door de dood of ingeval van echtscheiding of scheiding van tafel en bed, naar de toestand per de aanvang van de dag van het instellen van een verzoekschrift daartoe."

Prenup. I don't know what they mean by 'De verrekening heeft plaats naar de toestand'. Any ideas? Thanks!

takes place in accordance with the situation

De verrekening heeft plaats naar de toestand ten tijde van de ontbinding. The settlement takes place in accordance with the situation at the time of the dissolution...This is straightforward, if somewhat legal, Dutch and there is nothing particularly difficult about it. If you feel it fits better, you could use some other synonym for 'toestand' such as 'state' or 'position' but it's much of a muchness.
Note from asker:
Yeah, I had the same translation in mind, but since I don't do legal translations often, I was somewhat wary. Thanks!
Peer comment(s):

agree Richard Purdom : more simply, 'settlement depends on the situation'

agree Lianne van de Ven : I can't say this sounds like straightforward Dutch to me. Maybe it's from a legal document from one of the Dutch territories in the Caribbean? In NL we would say 'in overeenstemming met' (de situatie) or possibly 'naargelang de situatie'.

agree Tina Vonhof (X) : Legal language needs to be precise, not 'more simply' or 'straightforward Dutch'.
