I would like some feedback on two terms I am trying to translate properly from Dutch to English in a contract.

The translation is for a short addition to a previous lease agreement. In Dutch it reads:
ALLONGE (OP BESTAANDE HUUROVEREENKOMST)

I know what it means, but what would be the correct term to use for Allonge in English? Addendum to Lease Agreement? Amendment? Or is Allonge used as well?


As a small note, it also refers to "de (on)zelfstandige woonruimte" in the document. I know that it means that the premises either have or don't have their own entrance, but is there a specific, concise term I could use for it in English?

I don't see Schedule (attached or separate) - Endorsement to an Insurance Policy, Appendix to a set of accounts or Codicil to a Will for that matter - in any ProZ glossary entries, but I'm sure that's the term we used in our City of London conveyancing dept.

Otherwise, with the scattergun alternatives already on offer, I'd steer clear of Lease Rider, esp. for US AmE consumption : 'A LEASE RIDER is an addition to the lease indicating a specific condition of that lease that *varies* from the printed terms of the lease document.'

As for the second query, pre-posting as a separate question, '(non-)freestanding and (un-)detached' may work for buildings, rather than non-separate for premises.

Well, other readers (esp. my faithful disciples offlist) may have learned something and be grateful : synonym appreciative of these 'trivial' distinctions. Otherwise, describing a sep. Codil as an Attachment or Annex to a Will is asking for legal trouble.

ALLONGE (Legal Dictionary of Contracts)
A piece of paper which has been attached to a contract, a check or any promissory note, on which to add signatures because there is not enough room on the main document.

AMENDMENT (Legal Dictionary of Contracts)
A document by which significant changes are made to the terms of an executed contract. Changes requiring an amendment include, but are not limited to adjustments in costs, services, time period, and method of payment. The amendment is incorporated as part of the original contract.

ADDENDUM (Legal Dictionary of Contracts)
A document used to expand or more fully explain the terms of a solicitation which is incorporated as part of the original solicitation. This modification becomes a legal part of the solicitation. This term should not be confused with a contract amendment as it is not used to change the terms of a contract.

Wat is een allonge precies?
Een allonge is een document dat aan een contract wordt toegevoegd. Het wordt gebruikt om wijzigingen of aanvullingen op het oorspronkelijke contract aan te brengen. Hierdoor hoef je geen nieuw contract op te stellen als er tijdens een lopend huurcontract wijzigingen moeten worden aangebracht.

Een allonge is een mooi woord voor een aanvulling op de huurovereenkomst. Een allonge wordt gebruikt om na het afsluiten van een huurovereenkomst of gedurende de looptijd ervan aanvullende afspraken te maken over bijvoorbeeld de huur van extra vierkante meters, parkeerplaatsen, aanpassing van de servicekosten of wijzigingen van looptijd of huurprijzen ten opzichte van de eerder overeengekomen uitgangspunten vastgelegd in de hoofd huurovereenkomst.

A Lease Amendment is used to modify an existing Lease Agreement between a tenant and landlord by adding or removing clauses, or changing existing clauses. An amendment allows the parties to change the terms without having to sign a new Lease Agreement.

What is a Lease Amendment?
A Lease Amendment, also known as a residential Lease Amendment, is used to make changes to an existing Tenancy Agreement. The rest of the original agreement remains in effect, but with the amendments included as an attachment.

Landlords and tenants can use a residential Lease Amendment to change or add terms in an existing Tenancy Agreement. In order for the amendment to be valid, both the landlord and tenant must sign it to indicate that they agree with the changes or additions.

What changes can a Lease Amendment be used for?
A Lease Amendment is generally used for straightforward changes to the Tenancy Agreement, such as:

A change in rent amount
A change in frequency of rent payments
Changes in responsibility for utility payments
Changes in rental permissions (such as pets)

Although there is technically no limit to the number of changes you can make and no restrictions in relation to the complexity of the changes made with the Lease Amendment, it is best practice to create a new agreement if the changes amend most of the existing content of the Tenancy Agreement.
