Hello,

In the articles of association of a limited company by shares, there is often a distinction made between :

company ; firm and person.

I would normally translate company and firm by Société, but is there any subtlety regarding the term 'firm' I may be missing?

Donc, sous réserve du contexte, "company, firm and person" pourrait être traduit par "société, entreprise et personne". Néanmoins, il faut savoir qu'en anglais, il y a souvent des énumérations comprenant des termes redondants, auquel cas il est préférable de supprimer de ne garder qu'un seul terme pour chaque sens différent. Par exemple, "terms and conditions" se traduit de préférence "conditions", plutôt que "termes et conditions", qui évoque inévitablement une traduction depuis l'anglais. Il faut donc voir d'après le contexte, s'il est vraiment justifié d'avoir un terme différent pour rendre "company" et "firm" ou si "société" ne suffit pas.

Une company est plutôt une activité commerciale (vente de produits, prestations manuelles) - supermarché, entreprise de réparation de climatiseurs ...) tandis qu'une firm fournit des prestations plutôt intellectuelles (école de langues, bureau d'ingénieurs-conseils, architecte, etc.).

'Activité commerciale, activité de services, particulier' ???

La ponctuation de 'company ; firm and person' m'interpelle. Cache-t-elle qqchose ?

neutral  AllegroTrans: a firm can be a commercial undertaking - e.g. a shop, a repair garage,a hairdresser, so this doesn't really work. I think (for GB) the real distinction is between a legal entity and a non-legal entity undertaking, not the activity

disagree  Daryo: When it comes to "articles of association" a "company" is a legal entity nothing more nor less. (CL5+ about that) // BTW a "dormant company" *is* a very real company that does NOTHING; a "holding company" only owns other companies, etc ...
