24.8 Acceleration in the case of an unjustified rejection

If the main contractor rejects, in whole or in part, a justified demand for an extension of time limits, the subcontractor may choose to treat the rejection as an instruction to accelerate, issued as a change order. The subcontractor may not so choose if the consideration payable with respect to acceleration must be considered likely to exceed the daily penalty charge which would have accrued if the main contractor's rejection had been justified and acceleration had not taken place, plus an additional 30%.
