In questo articolo esaminiamo il rapporto esistente fra la responsabilità civile delproduttore per danni cagionati da prodotti difettosi, disciplinata dal D.P.R. n. 224 del 1988, e le norme volontarie che servono a certificare il sistema di qualità aziendale, in particolare la UNI EN ISO 9001 : 2000 (facente parte della c.d. “Vision 2000”, come è definita la generazione delle norme ISO 9000 emanate nell’anno 2000 ed attualmente in vigore), che, certificando la qualità dei processi aziendali, garantisce indirettamente anche la qualità del prodotto o del servizio realizzato od erogato dall’impresa.

La responsabilità del fabbricante per "Prodotti difettosi” ha trovato la sua disciplina nel DPR 224 del 24 maggio 1988, dove l’Art. 1) tale decreto stabilisce che il “produttore di un bene” è responsabile del danno cagionato a terzi da difetti del prodotto stesso”.
Per prodotto si intende ogni bene mobile anche se incorporato in altro bene mobile o immobile.
