Verschaffung der Verfügungsmacht

Hi all,

The above combination of terms is used in a dispute between a company's tax advisor and the German tax authorities over whether a transaction between two companies in a group was subject to USt.

The term refers to the condition under which a transaction can be considered to be a real sale of goods or services.

The Verschaffung der Verfügungsmacht includes within it the "Übergang von wirtschaftlicher Substanz, Wert und Ertrag" of the article being purchased.

Can anyone suggest a suitably elegant translation of both terms: "Verschaffung der Verfügungsmacht" and "Substanz, Wert und Ertrag"?

agree RobinB : "control” is certainly right, but we normally talk of “obtaining” control in a financial and/or corporate legal context. The German term itself appears in section 3(1) of the UStG.
