Agency usually fits as a legalistic translation for Auftrag: Auftrag zur grundbücherlichen Durchführung und Vollmachten > Agency for completion of (Austrian) land registration.
In my property-buy case in Vienna, it had been a Rechtsanwalt - rather than the Notary signing off the coinveyance - who had acted as agent receiving the Baukredit /mortgage monies.
Escrow in the UK is used for docs. & deeds desposited subject to a condition, rather than trust monies that are held as stakolder.

You, Mary per discussion entry, are welcome. Agency seems to fit as a 'neutral' term. As a practical matter, having had a Treuhandauftrag forced on me to stop me receiving the mortgage loan monies direct, I cannot say that I - on buying my apartment in Austria - had given any instruction, order or mandate to either the lending bank, Rechtsanwalt or öffentlicher Notar to set up the scheme.
It was merely part of the deal in a local custom that has echoes of a US American escrow or UK estate agent (realtor) or lawyer acting as a stakeholder for both parties vs. a lawyer etc. agent acting for either the buyer or the seller but not allowed to act for both.

Thx for keeping me on my toes. 1. Instruction usually pluralises in BrE, plus I had a problem with 'erlischt': the instruction vs. agency expiring 2. in my flat-buy case, it was the bank that gave my/its 'Auftrag' to the Rechtsanwalt + notary as agents.
