In UK statutes, exception means an exemption from a rule, evidentiary or otherwise. The present participle is waiving and not waivering - wavering (or havering in Scottish, besides meaning talking nonsense!) - denotes hesitation. A defence in this case of contract performance (execution means signing a contract vs. implementation or job completion) might include frustration of contract (impossibility) or split liability, namely trying to blame a joint contractor or a manufacturer of flawed tools, paint (famous English contract case) and equipment for a fault.
