lenders in this context:- a mortgage for a fixed amount (Hipoteka zwykła) where the mortgage is fixed to the amount of the indebtedness which is known at the time of execution of the mortgage; and a mortgage for an amount up to a cap (Hipoteka kaucyjna) where the indebtedness may not be known on day one and consequently a cap of liability is inserted.
