disagree  Claudia Costa: Automatically nada tem a ver com ex officio, que significa: "by virtue of position". "De ofício" é a expressão na LP equivalente à expressão latina "ex officio" = dever do juiz em arquivar o processo, ao verificar determinadas condições exigidas p/ norma.

  -> Claudia..o português diz "de oficio" que não é ex-oficio..you don't dismiss a case by nature of position, you dismiss if by nature of what it is..it's is known as "automatic dismissal"...I don't see why that is a problem...:)
