Source text - English Today, the role of multinational companies in developing countries is a subject regularly discussed in various fora and by many different interest groups.
Their concerns, expressed in numerous reports and studies, tend to focus on the alleged exploitation ofdeveloping countries by foreign companies, which are motivated solely by profit and without concern for the needs of their host countries.
Accusations levelled against these companies include: being of a size and power which jeopardizes the sovereignty of nations, manipulating world trade to the detriment of the Third World, and exploiting cheap labour. Charges such as these regularly attract media attention, for the "David" of the developing countries pitted against the "Goliath" of big business makes good copy- certainly better than a catologue of Goliath's good points. That is not to say that Goliath should sit back and complain that he is misunderstood; were he to do so, a mistaken opinion might become established before the facts had been verified.
The international business world has perhaps been slow to appreciate the damage which can be done by mistaken opinion- particularly when modern communications techniques can publish it to such a large audience in such a short time, and the output of information from companies has not always matched that of their most vociferous critics.
Of course it is certainly time to say that some of them are unlikely to be influenced by pro-business arguments, because of their ideological opposition not only to multinational companies, but to the entire economic system within which they operate.
But the mistake is to conclude that it is pointless to refute criticism or, even more importantly, to put forward the positive point of view.

Vandaag de dag is de positie van multinationale ondernemingen in ontwikkelingslanden een onderwerp dat regelmatig in diverse forums en belangenorganisaties wordt besproken.
Hun bezorgdheid, die in diverse rapporten en studies naar voren komt, richt zich gewoonlijk op de vermeende uitbuiting van ontwikkelingslanden door buitenlandse ondernemingen, die uitsluitend op winst belust zijn, zonder daarbij rekening te houden met de behoeften van hun gastlanden.
Beschuldigingen die aan deze ondernemingen gericht worden behelzen het volgende: van een zodanige omvang en invloed zijn dat de soevereiniteit van landen in gevaar wordt gebracht, het manipuleren van de wereldhandel ten nadele van de derde wereld, en het uitbuiten van goedkope arbeid.
Zulke beschuldigingen trekken regelmatig de aandacht van de media omdat, de “David” van de ontwikkelingslanden tegenover de “Goliath” van de grote ondernemingen, goed verkoopt – in ieder geval beter dan een opsomming van de goede kwaliteiten van Goliath.
Dat wil niet zeggen dat Goliath achterover moet leunen en zich moet beklagen dat hij niet goed begrepen wordt; zou hij dat doen, dan zou een verkeerde mening kunnen worden gevormd nog voordat de feiten onderzocht zijn.
De internationale zakenwereld is misschien nogal traag geweest in zijn besef dat een verkeerde mening schade kan aanrichten – vooral omdat moderne communicatietechnieken deze in een zeer kort tijdbestek aan een breed publiek kan bekendmaken, en de gegeven informatie van bedrijven niet altijd in overeenstemming is met die van hun goedgebekte critici.
Wellicht is nu de tijd aangebroken om naar voren te brengen dat sommigen van hen waarschijnlijk niet beïnvloed worden door pro- zakelijke argumenten, door hun ideologische tegenstand, niet alleen tegen de multinationale bedrijven, maar tegen het hele economische systeem waarin zij werkzaam zijn.
Het is echter verkeerd te concluderen dat het nutteloos is de kritieken te weerleggen, of wat nog belangrijker is, het positieve gezichtspunt naar voren te halen.

1.1 In deze algemene voorwaarden worden de hierna volgende termen in de navolgende betekenis gebruikt, tenzij uitdrukkelijk anders is aangegeven:
Gebruiker : Jansen Produkten B.V. de gebruiker van de algemene voorwaarden, tevens aan te duiden als verhuurder, verkoper, of opdrachtnemer; Wederpartij : de (rechts)persoon, die met gebruiker een overeenkomst sluit of heeft gesloten, tevens aan te duiden als huurder, afnemer, koper of opdrachtgever; Overeenkomst : de overeenkomst tussen gebruiker en haar wederpartij; Goederen; Producten; Artikelen; Zaken:Voortbrengselen van productieprocessen, objecten van dienstverlening en handelswaar. De begrippen worden door elkaar gebruikt al naar gelang hun specifieke toepassing.
1.2 AIle aanbiedingen, overeenkomsten en de uitvoering daarvan worden uitsluitend beheerst door de onderhavige voorwaarden. Eventuele afwijkingen zijn slechts geldig indien deze uitdrukkelijk schriftelijk tussen partijen zijn overeengekomen. Daaronder begrepen afwijkingen in offertes, aanbiedingen en overeenkomsten.
1.3 Indien gebruiker met opdrachtgever meer dan eenmaal overeenkomsten sluit, gelden terzake alle volgende overeenkomsten steeds de onderhavige algemene voorwaarden, ongeacht of deze
al dan niet expliciet toepasselijk zijn verklaard.
1.4 De toepasselijkheid van eventueel door de wederpartij gehanteerde voorwaarden wordt uitdrukkelijk uitgesloten.
1.5 Eventuele nietigheid of ongeldigheid van een of meer bepalingen van deze voorwaarden laten de geldigheid en de toepasselijkheid van de overige bepalingen van deze voorwaarden onverlet. Partijen zullen alsdan voor de nietige c.q. vernietigde passage een regeling treffen die de bedoeling die partijen met de onderliggende overeenkomst dan wel met deze algemene voorwaarden beoogden het dichtst benadert.
1.6 De onderhavige voorwaarden zijn eveneens van toepassing op alle overeenkomsten, voor de uitvoering waarbij derden zijn betrokken.
1.7 Bij adreswijziging van de wederpartij is deze verplicht gebruiker hiervan onmiddellijk in kennis te stellen.

1.1 Under these general terms and conditions the following terms with the following definitions are used hereafter, unless it is specifically specified otherwise:
User: Jansen Produkten B.V. the user of the general terms and conditions, also referred to as lessor, seller, or supplier; Opposing party: the (legal) body, who will enter or has entered into an agreement with user, also referred to as lessee, consumer, buyer or principal; Agreement: the agreement between user and opposing party; Goods; Products; Items; Transactions: Products of production processes, objects of services and products. The definitions are used in random order according to their specific applications.
1.2 All offers, agreements and the implementation thereof are exclusively governed by present terms and conditions. Possible variations are only valid if these are explicitly agreed upon between contracting parties in writing. This includes variations in quotations, offers and agreements.
1.3 If user enters into an agreement with principal more than once, the general terms and conditions always apply to all following agreements, no matter whether these have explicitly been declared applicable or not.
1.4 The applicability of possible terms and conditions used by the opposite party is explicitly excluded.
1.5 Possible nullity or invalidity of one or more conditions of these terms will leave the validity and applicability of the other conditions of these terms intact. Contracting parties will then come to an arrangement for the null and void and/or invalid passage which is roughly the same purpose as intended by contracting parties regarding the underlying agreement or these general terms and conditions.
1.6 The present conditions are also applicable to all agreements, involving performance by third parties.
1.7 If opposite party changes address he is obliged to notify user instantly.
