I don't think that this is anything to do with "due diligence"; it is drafting a deed or agreement. The role of a notaire in France is not like anything in the UK. Though some of what a notaire does may be done by a solicitor in the UK, their roles and responsibilities are generally very different. The usual equivalent of a solicitor is an avocat.

Formalities, not role or responsibilities. It is not up to them to tell the Notary what his responsibilities are! Harrap's Law Dictionary gives "formalities" as a translation of "diligences" and I believe that there should be an "s" on the end of "diligence" in your source text.

It's for the reader to enquire further if he/she needs to, not for the translator to "convert" the term into something else just to suit Americans, Brits, or anyone else
Impractical and undesirable NOT to use the words "notary" and "notarial" in English, even if notaries in civil-law countries are nothing like a notary public in the Anglosphere.
