Italian term

disposizioni di legge di carattere imperativo

Italian to English Bus/Financial Law: Contract(s) General Conditions of Use
Terms and Conditions of Use (of a business that sells food products online)

The entire second sentence (59 words long) all seems terribly redundant, but it must be included. Legal provisions of an imperative nature? Aren't all legal provisions 'imperative' or at least prescriptive in nature? Thanks for any suggestions.

Discussion

Thomas Roberts Nov 25, 2013:
The point is more that the law may require a form of writing that cannot be satisfied electronically - i.e. it may have to be done on paper following particular procedures.
Janice Giffin (asker) Nov 25, 2013:
the last 4 words Thank you both for these comments. I will point them out to the client. In this type of General Terms and Conditions of Sale/Use document, is there any type of transaction or service agreement that does NOT require a written form, whether electronic or paper-based? I find it hard to imagine.
Thomas Roberts Nov 25, 2013:
the last four words apply to the requirement of written form
philgoddard Nov 25, 2013:
Those last four words, "quando previsto dalla legge", are also redundant. The rest of the sentence says that they will accept electronic communications except where the law specifies otherwise, and then they say "where required by law".

law

I would translate it as "except where otherwise required by law".

I agree that "di carattere imperativo" is redundant, because there's no such thing as an optional law that you can comply with if you feel like it.

neutral philgoddard : This is a tautology in my opinion - if they're not mandatory, they're not requirements.

Italian term (edited): ....... disposizioni di legge di carattere imperativo

imperative legal provisions

"terribly redundant?!" Maybe. However has a straightforward legal meaning for the Italian burocrats.

The second sentence concerns "equipollence" between different ways for transmission of legal documents.
Note from asker:
Thanks very much, Francesco.
Peer comment(s):

neutral Thomas Roberts : imperative is never used in this sense in legal English
