French term

cours

French to English Bus/Financial Law: Contract(s)
LA BANQUE ne sera en aucun cas responsable du cours auquel sera effectue la realisation du gage.

Part of a deed of pledge... In the part that talks about execution of the terms of the pledge and what might be done with the pledged assets, etc. After this clause, it goes on to explain about the costs of such an operation.

Discussion

Nikki Scott-Despaigne Mar 1, 2015:
Asker In this part of your document, currecny is involved. Chances are this therefore describes exchange rates. However, if there is still uncertainthy, I think you may need to clear this up with your client directly as it may simply be describing a going rate (market rate, - price).
Richard Vranch (asker) Feb 27, 2015:
@allegro Yes, there is in this part, but costs are also mentioned too so I am torn between the two...
AllegroTrans Feb 27, 2015:
Asker Is more than one currency involved here?

exchange rate

Is something the bank would not be able to control and so might fit here.
Peer comment(s):

agree AllegroTrans : It certainly fits, but it isn't definitive; asker could confirm if moree than one currency is involved

agree writeaway : didn't we just have this recently? http://www.proz.com/kudoz/french_to_english/business_commerc...

agree Nikki Scott-Despaigne : In view of the further information that two currencies are involved here.

price

Referring to the future sale price of the pledged asset should the bank decide to execute the pledge in the future?
Peer comment(s):

agree Mark Nathan : yes, this might be more likely - it really depends on the nature of the pledge

All depended on fuller context.
agree Simon Charass : The Bank will not be responsible for the price at which the pledged assets will be realized.

Thanks. Really depended on fuller context.
neutral Edgar Bettridge : I think that this is most likely, but not really enough context to be sure that FX answer is wrong

Based on your answer, neutral seems strange here. Better to agree with FX answer, with proviso..

Cost/Price

market price

By definition, market prices change over time: it's called the law of supply and demand. So the lender cannot know in advance the market prices of the pledged assets in case of default in the future.
Peer comment(s):

neutral Edgar Bettridge : maybe - but "market" price suggests to me that asset is listed on a market. Perhaps it isn't?

It means that no price remains the same forever. For instance, you may pocket a capital gain by swelling your house today. Why? Because there is no reason the purchase price of your house today would be the same as the one when you bought it.
neutral Nikki Scott-Despaigne : Good suggestion, except that we now know that currencies are involved here.

How do you know that? La realisation d'un gage veut dire la vente des actifs qui ont ete mis en gage. Point a la ligne.
