Spanish to English Marketing Law: Contract(s)
The sentence, from a Supply Contract in Spain, is:

Constituye obligación del Proveedor la entrega de todas las mercancías pedidas en conformidad (...), no padeciendo las mismas de cualquier fallo o defecto de comercialización y en condiciones de ser libremente comercializables en cualquier unidad comercial.

I find these expressions quite often in Spanish, but I never think a gerund can work in English.

I'd simplify it with something like "... and they mustn't bear any marketing failure or default and must be in conditions...", but I'd like to ask for your opinion in case you have any better solution.

English tends to be a lot less wordy. You could substitute the entire "no padeciendo las mismas de cualquier" for "without any".
