Hi everyone! I'm translating the following academic abstract and am struggling with this phrase. Any help appreciated! Thanks in advance.

1. Sobre la fundamentación de las sentencias y el arbitrio judicial. Un recuento de la marcha hacia la codificación en la Ciudad de México (Siglo XIX)
Resumen
La justicia criminal del fuero ordinario experimentó un tránsito importante durante el siglo XIX que la llevó a desprenderse de las antiguas bases que la sustentaban, como el arbitrio judicial, ***atribución de jueces que los eximía de fundamentar sus sentencias*** y adoptar las exigencias de la modernidad que los obligaba a ello. En la Ciudad de México semejante cambio pasó por tres momentos durante los cuales se implementó la exigencia en la fundamentación de las sentencias y la exacta aplicación de la ley; ambos aspectos se reforzaron y posibilitaron con la Ley de 5 de enero de 1857 y posteriormente con el Código Penal de 1871.

From what I understand, "arbitrio judicial" doesn't mean absolute discretion. Rather, it affords judges the powers of a legislator, i.e. to render decisions in cases where no law exists or where the law is insufficient to render judgment (hechos no tipificados). However, the dispensation for this grounding is only given with respect to the LAW (fundamentación), not the FACTS (motivación), a distinction that may well be worth mentioning here.

According to the "Diccionario Bilingüe de Terminología Jurídica", the legal grounds are "fundamentos de las sentencias".

It's another option and I'm not sure about the use of "them" in your version. The authors are Francisco R. Bossini and Mary Gleeson.

A power granted to judges which exempted them from substantiating their verdicts

The source text does not specify the type of fundamentals the judges were exempted from setting, e.g. legal or otherwise. Hence, a general approach seems appropriate.
