Acquired distinctiveness and secondary meaning are different terms for the same thing. To be treated as a trademark a mark must have a certain quantum of distinctiveness. That distinctiveness can be inherent in the mark, i.e. inherent distinctiveness, or be developed in the minds of the consumers, i.e. acquired distinctiveness. Acquired distinctiveness may be thought of as consumer recognition of the trademark as an identifier of source, sponsorship, affiliation or other business relationship.

Stečena razlikovnost
"Znakovima koje je Zavod preliminarno odbio na temelju nerazlikovnosti, opisnosti ili generičnosti (čl. 5. st 1. točke 2., 3. i 4. Zakona), neće biti odbijena registracija ako podnositelj prijave za registraciju žiga dokaže da su stekli razlikovnost. Podnositelj mora dokazati da je znak prije dana podnošenja prijave i slijedom uporabe stekao razlikovni karakter u odnosu na proizvode ili usluge za koje je zatražena registracija. Dakle, podnositelj ne mora dokazati samu upotrebu žiga, već da je znak koji bi inače bio odbijen, kroz uporabu postao razlikovan, odnosno da li ga dovoljno veliki dio relevantne javnosti prepoznaje kao žig i preko njega identificira proizvođača."
