Context: er is een dodelijk ongeval gebeurd en de operator/exploitant heeft een vergoeding verkregen van de verzekeraar. De verzekeraar wil nu in naam van de operator/exploitant zelf een vergoeding eisen van de contractor/opdrachtnemer. De rechtzaak is dus tussen de verzekeraar en de opdrachtnemer.
