2.3 The Legal Gateway/Planning Meeting

The purpose of a legal gateway or planning meeting is for the LA to seek legal advice about a particular case. These meetings should be attended by the child’s social worker and managers together with the lawyer advising the LA. The social work team will usually set out the facts of the case, their concerns and explain what has been done to work with the child and family. The ultimate question will be “is the threshold criteria met and are court proceedings necessary at this stage?”
In those cases where it is agreed that it will be necessary to initiate Care Proceedings the LA will consider if it is appropriate to write to the parent to inform him or her that an application to court will be made shortly and to explain that he or she should seek legal advice ."

na sud by podali navrh na zverenie dietata do nahradnej starostlivosti, a obmedzenie rodicovskych prav a povinnosti, a podobne. teda ide o socialnu otazku, nie otazku trestnopravnu - v tomto meetingu sa nebude voci rodicom skumat trestnopravna zodpovednost. pojem skutkova podstata sa v slovenskom prave pouziva vylucne v trestnom prave, a prislusnymi organmi na jeho skumanie a posudzovanie su organy cinne v trestnom konani - policia, prokuratura, a sud. nie socialny urad, ani mestsky/miestny urad, aj ked ten moze skumat priestupky, ich skutkovu podstatu.
