English term

injunction

English to Spanish Law/Patents Law: Patents, Trademarks, Copyright
An injunction is available as a remedy for harm for which there is no adequate remedy at law. Thus it is used to prevent a future harmful action rather than to compensate for an injury that has already occurred, or to provide relief from harm for which an award of money damages is not a satisfactory solution or for which a monetary value is impossible to calculate. I am not sure about the technical translation in spanish.

Or \"orden judicial de desistir\"

In this context, \"orden judicial\" (a court order) may be too general; injunctions prevent those affected from carrying out certain actions (whether these be \"unfair\" business practices or a neighbor from having his usual smokey, annoying barbeque the day of my daughter\'s [backyard] wedding). :-)

Recognizing Mariela\'s (well-researched) contribution, I suggest \"orden de desistir/actuar\" (to cover the possibility of being legally refrained from, or compelled to, action).

injunction = orden de desistir/actuar
Peer comment(s):

neutral Mariela Malanij : your translation would be perfect if it were an order to refrain from doing a specified act but an injunction can also be an order to do an act. I think here it is used in a broad sense (it's part of MerriamWebsters explanation).

orden judicial conocida como injunction

just a sug.
You could leave it in English since you have the explanation right there.
The translation of injunction into Spanish depends on the context (whether it is an order to act or not to act or to stop doing something). Injunctions ordering someone to refrain from doing some acts are usually translated as Orden de desistir, etc. (See Marcelo's answer) but injuctions ordering to act have many possible translations depending on what is the action ordered.

Peer comment(s):

neutral Marcelo González : good source, but I'm not convinced that leaving it English is the best option. I suggest "...de desistir/actuar." Mariela, please see my comment below. :-)

I would still leave Injunction in English for reference: Orden de desistir/actuar (Injunction). Thanks for your input.
disagree Flavio Posse : The meaning is in the text, and unless you're tranlating into "spanglish" you should never leave it in english..The reference is in the original text: "Remedy for harm". Didn't you read it?
5 hrs
Yes I did. I'd leave the reference in English, otherwise, the reader might have a hard time to relate your version to injunction. I'd appreciate your reconsidering since this is not spanglish while "live" certainly is. Just different points of view. : )

amparo judicial

The word injunction has sevreal translations depending on the context. In this instance because the purpose this action is to be a "remedy for harm", a protective measure, I would use "amparo judicial".
Peer comment(s):

agree BAmary (X) : Sí, de acuerdo ya que una injuction es una medida cautelar. Además, "orden de desistir o de actuar", si bien puede ser una explicación de la medida, no es la forma correcta de decirlo en legalese. Lo he visto también como "interdicto".

Gracias Mary.
