De conformidad con el artículo 1.740 C.C. podemos definir el contrato de préstamo como: «aquel por el cual una de las partes entrega a la otra o alguna cosa no fungible para que use de ella por cierto tiempo y se la devuelva, en cuyo caso se llama comodato, o dinero u otra cosa fungible con condición de devolver otra, tanto de la misma especie y calidad, gratuitamente o con pacto de pagar interés, en cuyo caso se llama préstamo simple o mutuo.

That is "gratuitamente o con pacto de pagar interés" - a préstamo/loan is given freely or with an interest agreement.

La frase que citas, con variantes, sale mucho en traducciones de poderes y de constituciones de empresas, como ésta, de un banco de Colombia:
"....tomar o dar dinero en préstamos con o sin interés, dar en garantía o en administración sus bienes muebles o inmuebles, girar, endosar, adquirir, aceptar, cobrar, protestar, cancelar o pagar letras de cambio, cheques, pagarés, o cualesquiera otros títulos..."

I have banking, legal including notarial colleagues in London & Manchester who have drafted interest-free Islamic finance agreements in which the construction (interpretation) of the terms of loan, lending, borrowing, finance leasing or credit facility had never been a *practical* issue, rather the roll-up or front-loading of 'charges' in lieu of interest.

To factor in Sharia law, we should say 'to borrow or lend MONEY'. Why? Because the word 'loan' is ambiguous due to its financial implications.

Mi confusión es porque según yo todos los préstamos son con intereses, a menos que te dé el dinero alguien cercano que lo haga de buena fe, así que no entiendo el porqué la diferencia entre en préstamo y a interés.
