So I believe it refers to some kind of "private prosecution," where the state brings a prosecution only after a citizen/entity files a criminal complaint.

- rather than on the initiative of a private cititen. It is for the prosecuting authority to decide what happens at the next stage.
Also: delitos de acción pública are 'publicly prosecutable criminal offenc/ses' at the discretion of or automatically by the prosecuting authority rather than ones 'requiring' pub. pros.
BTW, this is not about a private prosecution that can be 'nolle prosequied' - stopped by the public prosecutor, Justice Minister or District Attorney / Attorney-General etc. from proceeding.
Also: delitos de acción pública are 'publicly prosecutable criminal offenc/ses' at the discretion of or automatically by the prosecuting authority rather than ones 'requiring' pub. pros.
BTW, this is not about a private prosecution that can be 'nolle prosequied' - stopped by the public prosecutor, Justice Minister or District Attorney / Attorney-General etc. from proceeding.
