NOTA EXPLICATIVA
Mecanismos legales que prevé la Ley No. 340-06 y sus modificaciones, así como su Reglamento de aplicación aprobado mediante Decreto No. 543-12, para garantizar los derechos de los proveedores:
I- ****Recurso de Impugnación (de Reconsideración).
Base legal: Artículo 67 de la Ley No. 340-06 y sus modificaciones
Formalidades:
1) Por escrito ante la entidad contratante
2) En un plazo no mayor de diez (10) días calendario a partir de que se conozca el hecho impugnado.
3) La entidad contratante notificará la interposición del recurso a los terceros involucrados en un plazo de dos (2) días hábiles.
4) Los terceros estarán obligados a contestar sobre el recurso dentro de un plazo de cinco (5) días calendario, a partir de la notificación del recurso.
5) Luego de vencidos estos plazos la entidad contratante tiene un plazo de quince (15) días calendario, para la emisión de la resolución dando respuesta al recurso de impugnación.
