privind moditicarea si completarea Legii nr. 349/2002 pentru
prevenirea si combaterea efectelor consumului produselor din tutun
Senatul adopta prezentul proiect de lege
Articol unic.- Legea nr.349/2002 pentru prevenirea si combaterea
efectelor consumului produselor din tutun, publicata in Monitorul
Oficial al Romaniei, Partea I, nr. 435 din 21 iunie 2002, cu modificarile
si completarile ulterioare, se modifica si se completeaza dupa cum
urmeaza:
1. La articolul 2, literele m) si n) vor avea urmatorul cuprins:
"m) spatiu public se intelege orice spatiu accesibil publicului sau
destinat utiliziirii colective, indiferent de forma de proprietate ori de
dreptul de acces;
n) spatiu de la locul de munca se intelege orice spatiu utilizat in
timpul orelor de munca, inclusiv masina de serviciu, ambulanta, taxiul;"

2. La arti.colul 2, dupa litera n), se introduc trei litere noi,·
lit.n1)_n3
), cu urmatorul cuprins:
"n 1
) spatiu inchis se intelege orice spatiu care are un acoperis,
tavan ori plafon si este delimitat de cel putin un perete, indiferent de
natura acestora si de caracterul permanent sau temporar;
n2
) mijloc de transport in comun se intelege orice vehicul
utilizat pentru transportul contra cost al persoanelor;
n3
) loc de joaca pentru copii se intelege orice spatiu public
destinat utilizarii de catre copii, inchis sau in aer liber."
3. La articolul3, alineatul (1) va avea urmatorul cuprins:
"Art.3.- (1) Se interzice fumatul in toate spatiile publice inchise,
spatiile inchise de la locul de munca, mijloacele de transport in comun,
locurile de joaca pentru copii, cu exceptia celulelor pentru detinuti din
penitenciarele de maxima siguranta."
4. La articolul 3, alineatul (2) se abroga.

regarding the amendment and completion of Law no. 349/2002 on the prevention and repression of the effects of tobacco product use
The Senate has adopted this bill.
Sole article. Law no. 349/2002 on the prevention and repression of the effects of tobacco product use, published in the Romanian Official Journal, Part I, issue 435 of June 21, 2002, with further amendments and completions, shall be amended and completed, as follows:
1. Points m) and n) under article 2 shall have the following content:
“m) ‘public space’ means any space accessible to the public or intended for collective use, irrespective of the form of property or the right to enter the said property;
n) ‘workspace’ means any space used during business hours, including the company car, ambulance, taxi;”
2. Three new points, points n1)-n3), shall be inserted under article 2, following point n), with the following content:
“n1) ‘enclosed space’ means any space with a rooftop, ceiling, or topside covering, and enclosed by at least one wall, irrespective of their nature and permanent or temporary character;
n2) ‘means of public transportation’ means any vehicle used for transporting passengers in exchange for a fee;
n3) ‘children playground’ means any public space intended for children use, either enclosed, or in the open air.”
3. Paragraph (1) under article 3 shall have the following content:
“Art. 3. (1) Smoking is forbidden in all enclosed public spaces, enclosed workspaces, means of public transportation, children playground, with the exception of prison cells for prisoners in maximum-security penitentiaries.”
4. Paragraph (2) under article 3 shall be abrogated.

Source text - Romanian Ca sărbătoare creştină Rusaliile se suprapun peste importante manifestări păgâne legate de cultul morţilor, fapt evidenţiat de majoritatea cercetătorilor; de obicei, alte informaţii referitoare la substratul păgân al sărbătorii nu se amintesc. Cu toate acestea există numeroase alte ecouri păgâne care au generat o serie întreagă de practici tradiţionale româneşti:
- desfăşurarea activităţii căluşarilor; ceata căluşarilor era compusă dintr-un număr impar de membri care se legau prin jurământ, pe 3,7 sau 9 ani, să păstreze secretul cu privire la orice activitate a lor. În perioada Rusaliilor ei îndeplineau mai multe funcţii: apărarea oamenilor de atacul ielelor, tratarea sătenilor de epilepsie, stimularea, prin dansul lor, a fertilităţii şi fecundităţii (R. Vulcănescu, Măştile populare, p. 169). Elementul specific de marcaj este steagul căluşarilor, împodobit cu o pânză neagră, ceea ce sugerează că „puterea lor vine din lumea strămoşilor” (L. Berdan, Totemism românesc, Polirom, Iaşi, 2001, p. 90). Personajul ce asigura protecţia cetei era Mutul, supus unei interdicţii totale a vorbirii pe timpul cât acţionează ceata. Manifestările căluşarilor îşi au originea în substratul traco-dac „în riturile de iniţiere masculină” (Tr. Herseni, Forme străvechi de cultură populară românească, Dacia, Cluj-Napoca, 1977, p. 271).
- împodobirea locuinţei cu elemente vegetale; în ziua de Rusalii se plasează crengi de tei, salcie, etc. la casă, la adăpostul animalelor, la grădina de legume, etc.; în unele zone se plasau ramuri verzi la casele unde erau fete de măritat. Elementul vegetal avea funcţie apotropaică şi era considerat un substitut al zeului vegetaţiei; se efectua această practică tradiţională şi la alte sărbători: Sf. Gheorghe, Florii, Paşti, etc. (v. M. Budiş, Microcosmosul gospodăresc, Ed. Paideia, Bucureşti, 1998, p. 88) şi îşi avea originea pe teren mitic indoeuropean.
- purtarea la brâu a unor elemente vegetale, plasarea lor pe pat; în sensul celor menţionate mai sus, usturoiul şi pelinul erau utilizate în practicile tradiţionale cu caracter apotropaic. Ele capătă o semnificaţie deosebită în contextul unor sărbători populare (Sf. Gheorghe, Arminden, etc.) şi bineînţeles în zilele de Rusalii. Să ne amintim că ele sunt prezente şi între elemente anexate la steagul căluşarilor. Prezenţa usturoiului şi a pelinului (care se plasa şi pe pat în timpul Rusaliilor) cu funcţie apotropaică şi în multe alte culturi, ne poate sugera originea acestui fenomen pe teren indoeuropean.
- sfiinţirea ramurilor de tei; în unele zone, Rusaliile mai poartă şi numele de Sărbătoarea teiului, în fapt, numele iniţial al sărbătorii, ceea ce ne sugerează faptul că această sărbătoare s-a suprapus peste o veche manifestare păgână derivată dintr-un cult arboricol (v. I. Evseev, Dicţionar de magie, de demonologie şi de mitologie românească, Ed. Amarcord, Timişoara, 1997, p. 458). Ramurile de tei, trecute prin procedura de tip creştin, sfiinţirea, îndeplineau funcţie apotropaică.
- împletirea cununilor; cununa este purtătoarea unor valenţe simbolice deosebite: poate indica natura divină a purtătorului ei, face parte dintre simbolurile solare, semnifică victoria (cununa de lauri), este asociată simbolic timpului, poartă simbolistica feminină, etc. De Rusalii se împleteau cununi din spice de grâu şi flori şi erau purtate de către tinerii căsătoriţi (v.I. Ghinoiu, Obiceiuri de peste an, Ed. Fundaţiei Culturale Române, Bucureşti, 1997, p. 166); această practică tradiţională şi-ar avea originea în mitologia indoeuropeană.
- practicarea obiceiurilor de înfrăţire; riturile respective se efectuau în jurul unui pom fructifer, în cimitir, în jurul unui brad, etc. de către copii, care păstrau relaţia de rudenie obţinută pe cale rituală până la sfârşitul vieţii. Conform credinţelor, riturile de înfrăţire erau patronate spiritual de către strămoşi. I. Ghinoiu menţionează faptul că fraţii de cruce se întâlneau, de obicei, de Rusalii. Pe baza informaţiilor acumulate, cercetătorii au ajuns la concluzia că riturile de înfrăţire îşi au originea pe teren mitologic trac.
Translation - English As Christian feast, Rusaliile overlaps with major pagan manifestations related to the cult of the dead, which is usually emphasized by most researchers; commonly, no other information related to the pagan basis of the feast is mentioned. Nevertheless, there are numerous pagan echoes that have generated an entire series of Romanian traditional practices:
- the activity of the căluşari; the group of căluşari consisted of an odd number of members bound together by means of an oath of secrecy regarding any of their activities; the oath would remain in effect for 3,7, or 9 years. During Rusalii, the căluşari would serve various functions, such as: protecting people from the attack of the iele, treating the villagers against epilepsy, stimulating fertility and fecundity by means of their dance (R. Vulcănescu, Măştile populare, p. 169). The specific marking element is the flag of the căluşari, decorated with a black fabric meant to suggest that “their power comes from their ancestors” (L. Berdan, Totemism românesc, Polirom, Iaşi, 2001, p. 90). The character ensuring the protection of the group was the Mute (the fool), who was subjected to a total prohibition of speech during the period when the group would act. The manifestations of the căluşari originate in Thraco-Dacian rituals, namely, „in the male initiation rites” (Tr. Herseni, Forme străvechi de cultură populară românească, Dacia, Cluj-Napoca, 1977, p. 271).
- decorating the house with vegetal elements; on the day of Rusalii, lime-tree, willow, etc. boughs decorate the front door of the house, the animal cots, the vegetable garden, etc.; in some areas, green boughs would decorate the front door of the houses inhabited by young girls of marriageable age. The vegetal element served an apotropaic function and it was considered to be a substitute for the god of vegetation; this traditional practice was performed during other feasts, as well: Saint George’s Day, Palm Sunday, Easter, etc. (see M. Budiş, Microcosmosul gospodăresc, Ed. Paideia, Bucureşti, 1998, p. 88) and it was rooted in Indo-European mythology.
- wearing waist-girdles made of vegetable elements, placing such elements on the bed; to the effect of the above mentioned, garlic and sage brush were used in traditional apotropaic practices. They acquire a special significance in the context of several folk feasts (Saint George’s Day, May Day, etc.) and, of course, on Rusalii. Let us remember that such elements are also present among the elements attached to the flag of the căluşari. The recurrence of garlic and sage brush (which were also placed on the bed during Rusalii) used to serve an apotropaic function in many other cultures, as well, may suggest that such phenomenon is of Indo-European origin.
- the blessing of lime-tree boughs; in some areas, the feast of Rusalii is also referred to as the Lime-tree Festival, which is, in fact, the original name of the feast. This hints at the fact that such feast overlapped with an ancient pagan manifestation derived from an arboreal cult (see I. Evseev, Dicţionar de magie, de demonologie şi de mitologie românească, Ed. Amarcord, Timişoara, 1997, p. 458). Lime-tree boughs that have been subjected to the Christian blessing procedure would fulfil an apotropaic function.
- twisting head wreaths; the wreath bears special symbolic significances: it may point to the divine nature of its wearer; it is one of the solar symbols; it denotes victory (the laurel wreath); it is symbolically associated with time; it also bears feminine symbolism, etc. On the day of Rusalii head wreaths were made of wheat ears and flowers and worn by newly weds. (see I. Ghinoiu, Obiceiuri de peste an, Ed. Fundaţiei Culturale Române, Bucureşti, 1997, p. 166); such traditional practice is deemed to have originated in Indo-European mythology.
- performing rituals of sworn brotherhood; the said rituals were performed around a fruit tree or a fir tree, in a cemetery, etc. by children that would maintain the kinship status they have acquired by means of such rituals for the rest of their lives. According to various beliefs, the rituals of sworn brotherhood were spiritually patronized by ancestors. I. Ghinoiu mentions the fact that sworn brothers would usually meet on Rusalii. On the basis of the information gathered, researchers have reached the conclusion that the rituals of sworn brotherhood originate in Thracian mythology.
