Source text - English 1. Warranty
1.1. The provisions in paragraph 12 UAV 1989/UAV TI 1992 expire and with regard to the liability for defaults (in the design as well as the performance of the work) that what is provided in article 7:761 DCC shall apply.
1.2. The defects liability period within the meaning of paragraph 11 of the UAV 1989/ UAV TI 1992 is 12 months as from the moment that the project has been delivered.
1.3. In line with the foregoing in paragraph 22 paragraph 1 UAV 1989/ UAV TI 1992 that what is stated in paragraphs 2, 3 and 4 shall expire and will be replaced by the following provisions:
1. The Contractor guarantees that the design worked out by it and the work realized by it complies with the Client Requirements. The period of this guarantee is 5 years. This guarantee entails:
a. that the guarantor (Contractor) undertakes to repair all arising defects at first notice of the Employer for its own account, unless the guarantor demonstrates that the defects are not for its account;
b. that the warranty will apply as from the completion of the project up to the delivery of the work and in connection thereto during the period stated in the Performance Specification.
2. If Contractor appoints a subcontractor or supplier, this does not discharge it from its obligations on the basis of this agreement. Contractor shall ensure the submission of the certificate of guarantee by the subcontractor or supplier to the Employer. If the certificate of guarantee has not been submitted by the subcontractor or supplier, the part in question is deemed to be guaranteed by Contractor.
1.4. If Contractor does not observe its warranty obligation within the term to be established by the board in case any default or shortcoming to one or several guaranteed parts of the work within the defects liability period, the Employer is entitled to have those activities which Contractor is obliged to carry out, at the expense of Contractor.

1.1. UAV 1989/UAV TI 1992 (1989 İşlerin İfasına Yönelik Standart İdari Şartlar/1992 Elektrik, Mekanik ve Tesisat İşlerinin İfasına Yönelik Standart İdari Şartlar) 12. fıkra hükümleri geçerliliğini kaybeder ve (iş verimliliğinin yanı sıra tasarımda da) yükümlülükleri yerine getirememe sorumluluğu ile ilgili HMK (Hollanda Medeni Kanunu) 7/761. maddesinde öngörülmüş hükümler uygulanır.
1.2. Geçici kabul süresi UAV 1989/UAV TI 1992 11. fıkra dâhilinde projenin teslim edildiği tarihten itibaren 12 aydır.
1.3. Yukarıda anılan UAV 1989/UAV TI 1992 22. fıkra ve 1. fıkra doğrultusunda 2, 3 ve 4. fıkralarda belirtilen hükümler sona erecek ve aşağıda belirtilen hükümler bunların yerini alacaktır:
1. Yüklenici hazırladığı tasarımın ve yaptığı işin müşteri gereksinimleriyle uyumlu olacağını temin eder. Teminat süresi 5 yıldır. Bu teminat aşağıdaki bahisleri zorunlu kılmaktadır:
a. Teminatçı (Yüklenici), kusurların kendisinden kaynaklanmadığını ispat etmediği sürece, kendisinden kaynaklı işverenin ilk etapta tespit ettiği ortaya çıkan bütün kusurları gidermeyi üstlenir.
b. Teminat projenin tamamlanmasından itibaren işin teslimine kadar ve ona bağlantılı olarak Performans Koşulunda belirtilen süre boyunca geçerli olacaktır.
2. Yüklenici eğer bir taşeron ya da tedarikçi tayin ederse, bu yüklenicinin sözleşmenin temelinde yer alan yükümlülük ve sorumluluklarını ortadan kaldırmaz. Yüklenici tayin ettiği taşeron veya tedarikçi tarafından teminat belgesinin işverene sunulması sağlayacaktır. Teminat belgesi taşeron veya tedarikçi tarafından işverene teslim edilmemişse, ilgili kısım yüklenici tarafından teminat altına alınmış sayılır.
1.4. Yüklenici geçici kabul süresi içinde kurul tarafından oluşturulacak şartlar dâhilinde teminat altına alınmış işin bir veya birkaç kısmıyla ilgili herhangi bir yerine getirmeme veya eksiklik durumunda eğer teminat yükümlülüğüne uymazsa, işveren yüklenicinin gerçekleştirmekte zorunlu olduğu işlemleri yüklenici pahasına veya hesabına yaptırma hakkına sahiptir.

İlgi (c) yazı ile gönderilen evrakın incelenmesi sonucunda, başvurunuzun Elektrik Piyasası Lisans Yönetmeliğine uygun olarak tamamlandığı tespit edilmiştir.
