A client's liability is stated to be: "une amende civile de 2 millions d’euros pouvant aller jusqu’à 3 fois le montant des sommes indûment perçues". Does this mean 2 million or three times the amount of sums wrongly collected or a maximum of 2 million, capped at three times such amount. This is under art. L. 442-6-III of the French Commercial Code which explains it in a different way but it is stilll not clear to me!!!

Ils peuvent également demander le prononcé d'une amende civile dont le montant ne peut être supérieur à 2 millions d'euros. Toutefois, cette amende peut être portée au triple du montant des sommes indûment versées.

Perhaps it would help if you actually posted that alternative explanation from the Code, since maybe it would be clear to someone else?

Hello,

If someone unfairly charged you $100, the fine could be as high as $300. I think that's what they are saying.

Nevertheless, this fee can amount to three times the total of the sums unduly collected. (in this way you also avoid repeating "amount").

Je ne suis pas spécialiste de droit commercial / de la concurrence et le texte officiel est effectivement ambigu, mais c'est ce que je comprends (confortée par la réf ci-dessous).

"Toutefois" indique une opposition :
plafond =
(a) 2 millions d'euros, **ou**
(b) la somme correspondant à trois fois le montant des sommes indûment perçues -

Dans le cas (b), il n'y a pas de montant maximal absolu (dc le montant de l'amende peut le cas échéant dépasser 2M€).

je pense donc que votre première proposition est correcte : "2 million or three times the amount of sums wrongly collected"
