In my mind "legal sanctions" would adequately cover the sense of the risque pénal here. My sense is that pénal refers here to a civil rather than criminal infraction

If so see Le Petit Robert definition..relating to civil as opposed to penal law to wit "qui fixe le montant des dommages-interêts à payer en cas d'inexecution d'un contract"
