I find the whole thing difficult to follow, too, but I think I get the gist. The "intérpretes" are judges or legal writers, I'm not sure which, and it says that they act more like parties to the contract than independent observers.

Based on your answers, perhaps “as non-party to the contact” or simply “from the outside” would sufficiently convey the meaning, as Phil said, that they (judges) should act as independent/impartial observers, rather than parties to the contract.
